Chevrolet Rollover – Crash Kills Teen

Joshua Blum died in a rollover crash when the 1986 Chevrolet pickup truck he was driving blew out a tire, causing the pickup truck to rollover and crash on Interstate 39 in Marquette, Wisconsin.  According to the Wisconsin Department of Transportation Mr. Blum was partially ejected from the truck.

Mr. Joshua Blum’s Chevrolet pickup truck was traveling southbound on Interstate 39 when it struck a median, overturned, and came to a stop in the northbound lanes.

Mr. Tim Blum, Joshua Blum’s father, made a comment about the accident which killed his 18 year-old son, “He wasn’t speeding…he wasn’t on drugs and he wasn’t drinking alcohol. He wasn’t wearing his seat belt. I wish he was, because this would’ve had a whole different outcome…Joshua’s friend was wearing a seat belt…and he’s doing fine.”

Mr. Alexander Miller, who is also 18 years old, suffered non-life-threatening injuries and was taken to Divine Savior Healthcare hospital.

Mr. Tim Blum also said about this accident and his son “He was pulling a trailer and a tire just blew on him…but this had nothing to do with my son. He was good about driving.”

If you have been the victim of personal injury you may be entitled to damages. Awarded in civil actions, personal injury damages are monies allotted to those who have been wrongfully injured by someone else. Damages are intended to help restore the victim physically, emotionally, mentally, and financially. The two main types of personal injury damages are compensatory damages and punitive damages.

Compensatory Damages

Compensatory damages, which are sometimes refered to as actual damages, cover all financial expenses and all ailments associated with personal injury, including:

  • Emotional distress
  • Pain and suffering (grief, fright, anxiety, humiliation, or depression)
  • Repair or replacement of property
  • Medical bills
  • Loss of wages
  • Permanent disability
  • Mental impairment
  • Earning capacity impairment

Punitive Damages

Often called exemplary damages, punitive damages are typically awarded to the plaintiff in addition to compensatory damages when the defendant’s conduct has been especially malicious or oppressive. Punitive damages are awarded to punish the offender and to deter others from engaging in similar actions.

How much can you receive in personal injury damages?
Personal injury damages are determined on an individual, case-by-case basis. The amount is decided by the jury but can be reviewed by the court. If a judge feels that the amount of damages is excessive, he or she can order remittitur, a process in which the punitive damages are reduced without a new trial or appeal. If a judge feels that the amount of damages is inadequate, he or she can order additur, whereby punitive damages are increased without a new trial or appeal.

Mountain View, North Carolina – 2 Firefighters Hurt in Fire Truck Rollover

Two firefighters were hurt when the fire truck they were riding in rolled over, while responding to a call in Mountain View, North Carolina. The firefighters were part of the Mountain View Volunteer Fire Department.

The accident happened on Zephyr-Mountain Park Road. The fire truck was carrying approximately 1,000 gallons of water, and was going around a curve when it went out of control. The fire truck went off the road to the right near a bridge. As the driver turned sharply to the left in an attempt to get the fire truck back in control, the fire truck skidded and rolled onto its right side.

Both the driver, Matthew Hurley II, and Matthew Wood, suffered injuries and were both taken to the Wake Forest Baptist Medical Center.

Witnesses noticed the fire truck rocking back and forth before the wreck happened, which was likely due to the water in the tank shifting, making it difficult to keep the fire truck under control.

Speed was not considered to be a factor in the wreck and another fire department was sent out to the original call, which turned out to be a false alarm.

Iowa Rollover Crash Kills Teen

An 18-year-old Sioux City, Iowa, man was fatally injured when an SUV went out of control and rolled numerous times early Monday northeast of Sioux City, the Iowa State Patrol said.

Four other teens were injured.

Nino Segura was taken by ambulance to St. Luke’s Regional Medical Center in Sioux City, where he died, the State Patrol said.

The four other men injured in the crash were taken to Sioux City’s Mercy Medical Center. The State Patrol identified them as Oscar Ramirez, Christian Bruce and Felix Lemeus, all 18 and of Sioux City, and Juan Munoz, 19, of Sloan, Iowa.

Bruce was treated at the hospital and released, and Munoz was in good condition Monday night, a hospital spokeswoman said. The conditions of the other teens were unavailable.

Ramirez was driving a 1998 Ford Explorer on a Woodbury County road about two miles northeast of Sioux City. The southbound sport utility vehicle went out of control, went into the east ditch and rolled in an adjoining pasture, the State Patrol said.

Segura was thrown from the vehicle.

A State Patrol report did not note whether any of the Explorer’s occupants were using seat belts.

Salt Lake City Rollover Accident Kills One

A woman died after a rollover crash on I-80 Sunday. Local authorities say that a Chevrolet SUV was towing a Toyota Camry on I-15 near the I-80 West exit in Salt Lake City early in the morning when another vehicle cut off the SUV as the driver tried to get onto the I-80 exit.

The SUV swerved in order to miss the other car. This caused the Camry to over correct and driver to lose control of the vehicle. It then rolled off the right side of the road and land on its roof. Another vehicle then cut in front of them and the driver of this vehicle hit his brakes, lost control, the vehicle swerved off to the right and rolled as reported by the police.

A lady in her mid 30’s was ejected from the SUV and suffered fatal injuries to the head and neck. Officials say the lady was one of nine people in the car that was passing through Utah as they traveled to Washington State. The woman was not wearing a seatbelt but the other passengers in the vehicle were buckled. Four children were transported to a local hospital with minor injuries. Utah law allows other passengers to be in a car as long as all seatbelts are being used, so the family will not be issued a citation. The woman who cut the SUV off has not yet been charged.

Continental Tire Recalls 400K Tires

(NewsCore) – Continental Tire announced Friday that it was voluntarily recalling 390,657 light truck tires in the US over fears they might experience uneven wear, vibration or separation between the belt edges, which could cause a crash.

The Fort Mill, S.C.-based company said that separation of the tires’ belt edges could lead to tread belt separation, which increases the risk of a crash occurring.

Continental added that most of the affected tires were installed on Ford F-250 and F-350 trucks from model years 2008 and 2009.

Approximately 60,000 of the 390,657 tires were sold in tire-replacement markets, it said.

Owners of the affected vehicles will be contacted, and the tires will be replaced free of charge.
